Subcontracting in patient advocacy can be a beneficial arrangement for all of us as small business owners and solopreneurs. Today, I’m shedding light on the intricacies of subcontracting agreements and how to navigate this business model successfully.

Legal Considerations in Subcontracting

When entering into subcontracting agreements, it’s crucial to have clear and concise terms and conditions that outline the responsibilities of both parties. Legal professionals can assist in customizing and redlining documents to ensure compliance with state-specific rules and regulations. Key components to address in contracts include expectations, non-poaching clauses, rates, and HIPAA compliance. Insurance coverage and W-9 forms for contractors should also be discussed to mitigate potential risks.

Differentiating between Employees and Subcontractors

Understanding the distinction between employees and subcontractors is essential to avoid legal ramifications. To avoid confusion it is important to align communication, work styles, and ethics when contracting with individuals. Determining the need for an employee versus a contractor depends on factors such as tasks, deadlines, and the level of leadership required. By vetting subcontractors thoroughly and setting clear expectations, you can foster positive working relationships and successful engagements 

Building Strong Working Relationships
